Is a woman's claim regarding the end of her Iddah based on months accepted?
General Chapter
Al-Mughni
Book of Reconciliation (Return During 'Iddah)
Primary text
The woman's statement regarding the completion of Iddah by months is not accepted because the disagreement on this is dependent on the disagreement over the timing of the divorce, and the husband's word is generally accepted regarding the timing of the divorce. However, if the husband claims completion of her Iddah to escape paying maintenance, and she contradicts him by claiming a later divorce date, her word is accepted because he is claiming something that negates an established obligation (maintenance), and the presumption is the obligation's continuation.
Supporting text
If the roles are reversed and the husband asserts a divorce date that would allow him revocation, but the wife claims an earlier date preventing the revocation, the husband's word is accepted because the presumption is the continuity of the marriage, and his word is accepted regarding the establishment and negation of divorce, thus applying to its timing.
