Is it permissible for an Imam to grant proprietary rights (*iqta'*) over uncultivated, common land (*mawat*)?

The Imam must not grant proprietary rights over uncultivated land (*mawat*) except for that portion which the grantee can actively cultivate and bring to life. Granting more than what can be revived constitutes undue restriction upon the people concerning a right they share in common, without yielding any benefit.
