What is the liability of a non-owner who destroys an obligatory sacrifice?
General Chapter
Al-Mughni
Book of Sacrifices (Uḍḥiyah)
Primary text
If a non-owner destroys an obligatory sacrifice, he is liable only for its value at the time of destruction, unanimously agreed upon, and must deliver this amount to the owner. If the value exceeds the price of a replacement animal, the ruling follows that of the owner destroying it.
Supporting text
If the value does not reach the price of a sacrificial animal, the ruling follows the previously established rule concerning the excess value beyond the price of the sacrifice in the case of the sacrificer.
