If the buyer offers the seller the full price, the seller does not possess the right to annul the contract because the agreed-upon price has been received. This is similar to a case where a defective item is purchased and the buyer accepts it for the full price.

If the buyer retains the item by paying a proportionate part of the price when the item is deficient, the seller has the option to either agree to this or annul the contract. This is because the seller only consented to sell the item for the entire price, and if he does not receive the full amount, he has grounds for annulment.
