Primary text

If one of the two items requiring possession perishes before the buyer takes possession, the buyer has the option either to keep the remainder with a corresponding deduction from the price or to void the entire contract. This is because the status of the item before possession remains under the seller's liability, similar to the status before the contract, evidenced by the buyer having the right to rescind if the item becomes defective before possession.
