What is the buyer's option if the sale involved partial ownership by the seller and the buyer was unaware of this fact?
Chapter on Selling the Musarrah (Animal with milk retained in udder)
Al-Mughni
Book of Sales
Primary text
If the buyer was unaware, such as believing an entire slave belonged to the seller when only half did, or believing two slaves were owned when only one was, the buyer has the option between rescinding the contract or maintaining it because the transaction partially failed for him.
Supporting text
The seller has no option to rescind because he consented to the transfer of his ownership for the apportioned price.
