Primary text

The correct view is that none of these transactions, including endowment, are valid because the sold item is subject to a right held by the seller that prevents the validity of the transaction, similar to a mortgage. Endowment is differentiated from manumission (Ataq) because manumission is based on dominance and pervasive effect, unlike endowment.

Another view mentioned by our associates suggests that the buyer's transaction involving endowment is valid because it is a transaction that invalidates the right of pre-emption (Shuf'ah), thereby resembling manumission.
