Chapter on Selling the Musarrah (Animal with milk retained in udder)

Book of Sales

Book 12 · Issue 4 · Bab 5

Open in Qurani

Primary text

If the buyer chooses to accept the item at the higher total price, the seller has no option to retract, as the seller has offered an increased benefit to the buyer, which the buyer accepted. This is analogous to a case where a buyer accepts a defective item despite knowing the defect.

Supporting text

If the seller chooses to waive the additional amount from the buyer (accepting the original contract price), the seller also has no option to retract, because the seller has already offered that waiver based on the price at which the contract was concluded, and both parties agreed to it.
