What happens if both parties present evidence supporting their conflicting claims regarding the subject matter of the sale?

Chapter on Selling the Musarrah (Animal with milk retained in udder)

Al-Mughni

Book of Sales

Book 12 · Issue 2 · Bab 5

Open in Qurani

Primary text

If each party presents valid evidence supporting their respective claim (e.g., one proving the sale of the slave and the other proving the sale of the female slave), both contracts are established because the claims are not mutually exclusive. This is similar to a situation where one party claims a sale of both items and the other denies it.

Supporting text

If only one party presents evidence supporting their claim while the other does not, the contract corresponding to the claim supported by evidence is established, and the claim without evidence is not.
