If the sale is ruled valid despite a void stipulation, the seller is entitled to recourse for the reduction in price caused by the condition. Similarly, the buyer is entitled to recourse for any increase in price if the buyer stipulated that increase, because the seller agreed to the price based on the intended benefit of the condition, and the buyer agreed to the price increase for their stipulated condition; thus, if the condition is unmet, the allowance should be reversed.
