Primary text

According to the apparent view of Ahmad and Al-Kharaqi, it is not permissible to sell meat for an animal of a different species, based on the prohibition of exchanging a live animal for a dead one. The argument against allowance is that all meat constitutes one genus, and the prohibition applies broadly. The argument for allowance is that the item subject to Riba (meat) is being sold for something other than its origin and of a different genus, thus permitting the exchange, similar to selling it for currency.

The view allowing it is favored by Al-Qadi, while Al-Shafi'i holds two differing opinions. If the animal is not one whose flesh is eaten (i.e., a non-edible animal), the sale is permissible according to the apparent view of our companions and the majority of jurists.
