Is the legal ruling for exception valid in manumission (freeing a slave) the same as in sale?
Chapter on Selling Assets and Fruits
Al-Mughni
Book of Sales
Primary text
The validity of excepting the fetus in manumission does not necessitate its validity in sale. This is because manumission is not hindered by uncertainty (ignorance/unknown nature) or the inability to immediately hand over the item, nor are the conditions of a sale required for manumission.
Supporting text
The primary evidence against its validity in sale rests on the previous arguments concerning the fat and fetus being indeterminate.
