What is the legal status of meat slaughtered in a region containing non-Muslim idolaters/Zoroastrians?
Chapter on Selling the Musarrah (Animal with milk retained in udder)
Al-Mughni
Book of Sales
Primary text
Purchasing meat slaughtered in a land containing idolaters and Zoroastrians who perform slaughtering is impermissible, even if it is possible that a Muslim performed the slaughtering. This is because the default principle is prohibition, which requires certainty or a strong presumption to be lifted.
Supporting text
If the area contains a mixture of Muslims and idolaters who slaughter, the prohibition on purchasing the meat remains. This is supported by the Hadith of Adi ibn Hatim concerning a dog sent to hunt that returned mixed with dogs not named over, where eating the quarry was forbidden because the specific killer could not be identified.
