Is the option established in binding contracts that one party controls unilaterally, such as assignment of debt (hawalah) and exercising the right of pre-emption?
Chapter on the Option of the Two Parties in Sale
Al-Mughni
Book of Sales
Primary text
There is no option in assignment of debt or the exercise of pre-emption because the one whose consent is not considered has no option. If the option is not established in one aspect of the contract, it is not established in the other, similar to all other contracts.
Supporting text
It is plausible that the option is established for the assignor (muhil) and the pre-emptor because these are transactions intended for consideration, thus resembling other sales.
