If a fruitful date palm is sold, and the fruit is not apparent (not mu'abbara), the fruit belongs to the buyer, provided the buyer did not stipulate otherwise.
Supporting text
Ibn Abi Layla maintained that the fruit belongs to the buyer even if it is apparent. Abu Hanifa and Al-Awza'i maintained that the fruit belongs to the seller even if it is not apparent, based on the analogy to crops in the ground.
