What is the ruling if an animal sold in exchange for grain is consumed before the buyer takes possession (Qabd)?
Chapter on Selling Assets and Fruits
Al-Mughni
Book of Sales
Primary text
If the animal was in the buyer's possession, the situation is equivalent to the buyer destroying it. If the animal was in the seller's possession or in the possession of a third party, it is considered as if the seller destroyed it. If the animal perished while not in anyone's possession, the sale is nullified because the object perished before possession through an event not attributable to a human, making it equivalent to perishing by the decree of God.
