What is the ruling regarding a party leaving the meeting place to avoid the finalization of the sale after the option has been established?
Chapter on the Option of the Two Parties in Sale
Al-Mughni
Book of Sales
Primary text
The Prophet (PBUH) stated: 'The two contracting parties have the option until they separate, unless the contract was conditional upon the option (safqa khiyar), in which case it is not permissible for him to separate from his counterpart out of fear that he might seek annulment.' The clear meaning of this Hadith indicates the prohibition of one party separating from the other out of fear of the sale being revoked. This is the apparent view of Imam Ahmad based on one narration, as the statement of the Prophet (PBUH) takes precedence over the action of Ibn Umar.

The apparent view of Imam Ahmad, based on Ibn Umar's practice of separating when he liked what he bought, suggests that such separation is permissible. However, the former view is stronger because the statement of the Prophet (PBUH) is superior to the action of Ibn Umar, and it is presumed Ibn Umar had not been informed of this ruling.
