Primary text

It is valid if a person borrows half a Dinar and repays with a whole, sound Dinar, declaring half as repayment (*qada'*) and the other half as a deposit (*wadi'ah*) with the lender. This ruling applies similarly if they agree upon a sale (*salam*) for an item. If the lender refuses to accept this arrangement, he has the right to do so because the arrangement imposes harm (*darar*) upon him in the nature of the partnership created by the deposit.
