If the seller consents to leaving the growth for the buyer, or states they will remove it, and this removal can be done in a short period without harming the land's productivity, the buyer has no option to annul the contract. The buyer must accept because the defect is remedied by removal, or the buyer benefits by its remaining, thereby validating the contract.
