Chapter on Selling Assets and Fruits
Al-Mughni
Book of Sales
Primary text
It is forbidden for the seller of bulk grain to deceive the buyer by placing it on a mound, a stone, or a base that reduces the volume, or by placing inferior or damp grain in the interior. If such deception is found, and the buyer was unaware, the buyer has the option to either rescind the sale or take compensation for the difference in value, as this constitutes a defect. If the bottom was found to be better than the surface, the buyer has no option, as it is an increase for him.

If the seller was aware of a defect underneath, the buyer has no option because the seller entered the transaction with full knowledge. If the buyer was unaware that the seller was knowledgeable, he has the option to rescind or affirm the sale, as this constitutes cheating and treachery by the seller. A view exists that the sale is void because it is prohibited.
