Is the sale of a free person permissible?
Chapter on Selling the Musarrah (Animal with milk retained in udder)
Al-Mughni
Book of Sales
Primary text
The sale of a free person is forbidden. This prohibition is universally agreed upon. The evidence is the divine statement narrated via the Prophet (peace be upon him): "Three I will be an adversary against on the Day of Resurrection: a man who gave a pledge in My Name and acted treacherously, a man who sold a free person and consumed his price, and a man who hired a laborer and took full payment from him but did not pay him his wages." This narration is reported by Al-Bukhari.
