Chapter on Selling Assets and Fruits

Book of Sales
Primary text
The seller who stipulated the usufruct possesses the right to lend (loan) or lease the object to someone who can utilize it in the seller's stead. This is permissible according to the primary legal opinion because the benefits are legitimately due to the seller, granting them the right to dispose of those benefits, similar to a lessee or legatee of usufruct rights. However, if the seller leases the property, the lessee must be one whose use does not cause greater harm to the object than the seller's own use.
Supporting text
The seller is prohibited from leasing or lending the object to someone whose manner of use would damage the property. This is prohibited because one cannot lease a rented property to someone who cannot fulfill the original usage terms.
