A claim of specific designation (ta'yeen) concerning the subject matter being sourced from that year's harvest is not valid. If the two parties had agreed to deliver the subject from something else, it would be permissible. The requirement for delivery from that year's harvest exists only to ensure the subject meets the required description, similar to how the seller is obligated to deliver from their own harvest if available and no other source exists; the harvest itself is not intrinsically specified.
