Is there financial compensation (Gharrām) required for killing a dog whose keeping is permissible?
Chapter on Selling the Musarrah (Animal with milk retained in udder)
Al-Mughni
Book of Sales
Primary text
No financial compensation is due upon the killer of a dog whose keeping is permissible, a position held by Al-Shafi'i. The justification is that since compensation for it is forbidden due to its inherent impurity, financial liability for its destruction is not established, similar to a pig. The prohibition on killing stems from the harm caused, and the Prophet (PBUH) forbade causing harm and mutual harm.
Supporting text
Malik and 'Ata' hold that financial compensation is due because of the prohibition against destroying something that is permissible to keep.
