Can a person who placed wood on another's wall lend or rent out that placement right?
General Chapter
Al-Mughni
Book of Settlement
Primary text
A person who placed his wood upon another's wall does not possess the right to lend or rent that placement to others. This right was granted solely due to his urgent necessity for placing his own wood. Since he has no necessity for placing someone else's wood, he does not gain ownership over that right. Furthermore, he cannot sell his right of placement, nor can he settle on its behalf with the wall owner or any other party, as the permission was granted due to his personal necessity, similar to the ruling concerning food belonging to another person permitted out of necessity.
