Is the removal of wood obligatory if its placement causes fear of the wall collapsing or if the need for it is removed?
General Chapter
Al-Mughni
Book of Settlement
Primary text
If the collapse of the wall is feared after the wood has been placed upon it, or if the owner becomes independent of the need to keep it there, removal is obligatory because the remaining wood causes harm to the owner of the wall, and the wood itself is removed.
Supporting text
If there is no fear of the wall collapsing but the owner of the wood becomes independent of the need to keep it there, removal is not obligatory. This is because removing it would cause harm to its owner, whereas keeping it causes no harm to the wall owner, unlike the situation where its presence causes fear of collapse.
