Is Zakah obligatory on the share of the fruit crop for each partner?
General Chapter
Al-Mughni
Book of Sharecropping (Musāqāh)
Primary text
It is obligatory upon each partner to pay Zakah on his share if that share reaches the minimum taxable amount (Nisab). This was explicitly stated by Ahmad concerning Al-Mazara'ah (sharecropping). If the combined shares do not reach the Nisab, Zakah is not obligatory, because in the sound opinion, commingling does not affect Zakah obligations except for livestock.
Supporting text
There is an alternative narration stating that commingling does affect Zakah obligations even here, meaning Zakah is calculated first, and then the remainder is divided.
