What is the consequence regarding the earnings of a *mudabbar* if he becomes fully free due to the arrival of absentee assets or debt recovery?
General Chapter
Al-Mughni
Book of Tadbir (Deferred Emancipation)
Primary text
If the entire slave becomes free due to the arrival of absentee assets or debt recovery, it is established that he was free at the time of the master's death, and therefore, his earnings belong to him. This is because he was freed by the *tadbir*, which is the fulfillment of the condition upon which the master suspended his freedom—namely, death. The suspension was for the doubt concerning his emergence from the one-third limit; once the doubt is removed, it is established that the condition was met before the doubt ceased. If the assets perish, it is established that two-thirds of him remained in servitude, and only his one-third was freed. If some of the assets perish, the portion of the *mudabbar* exceeding the value of the recovered assets becomes slave property.
