What happens to the *tadbir* if the master dies after the *mudabbir* commits a felony but before the penalty is exacted?

If the master dies after the felony but before the penalty is carried out, the *mudabbir* is manumitted under all circumstances, whether the penalty was monetary or required retaliation. This is because the qualification for manumission was established, equating it to a direct act of manumission by the master. If the penalty was retaliation, it must still be exacted, regardless of whether the victim was an enslaved person or a free person, because the obligation for retaliation was fixed while the *mudabbir* was in bondage and is not negated by the subsequent freedom. If the obligation was monetary, the amount paid is the lesser of the *mudabbir's* market value or the assessed value of the injury (*arsh*).
