Is the plaintiff's oath acceptable without accompanying male testimony?
General Chapter
Al-Mughni
Book of Testimonies
Primary text
The plaintiff's oath is not accepted without accompanying testimony. This is the view stated by Al-Shafi'i. The principle is that the combination of two weak elements, namely the testimony of two women and the plaintiff's oath, does not result in acceptance because the oath itself is considered weak and requires strengthening.
Supporting text
Imam Malik accepts the plaintiff's oath when presented alongside the testimony of two women in cases involving financial claims, viewing the two women as substituting for a man.
