Is the testimony of a partner for his partner valid?
General Chapter
Al-Mughni
Book of Testimonies
Primary text
The testimony of a partner for his partner is invalid because the witness is suspected (*mutaham*) due to the benefit accruing to himself or the warding off of harm from himself through his testimony. Shurayh, al-Nakha'i, al-Thawri, al-Shafi'i, and the People of Opinion rejected the testimony of a partner for his partner, and no dissent is known.

Al-Zuhri stated that the established tradition in Islam is that the testimony of an opponent (*khasm*) or a suspect (*dhaneen*) is not valid. Talhah ibn Abdullah ibn Awf narrated that the Messenger of God (peace be upon him) judged that there is no testimony from an opponent nor a suspect.
