What happens to the Mahr, offspring's ransom, and accountability upon the return of the slave girl to her owner?
General Chapter
Al-Mughni
Book of Usurpation
Primary text
If the slave girl is returned to her owner, her stipulated Mahr is due, and her children (who are free) must be ransomed to their value and returned to the usurper. All of this is then sought back from the usurper. This is based on the principle that 'that which is taken must be returned until it is restored' (Hadith: 'Alā al-yad mā ukhidha hattā yuraddahu').
