Who inherits the estate of a slave whose freedom has been established by judicial ruling?
General Chapter
Al-Mughni
Book of Usurpation
Primary text
If the slave dies and leaves behind property, the property belongs to the original claimant because all parties agree that it belongs to him. The slave is prevented from being returned to the claimant only because the right of freedom has become attached to him. However, if the slave leaves behind a legal heir, the heir takes the inheritance. No one establishes a claim of *Wala'* (the right of inheritance/allegiance upon manumission) over him because no one claims it.
