What is the liability when a usurped item is gifted to a knowledgeable person?
General Chapter
Al-Mughni
Book of Usurpation
Primary text
If the usurped item is gifted to a knowledgeable person who is aware of the usurpation, the guarantee rests entirely upon the recipient (the one to whom the gift was made). Whatever the recipient pays for the value of the item or its components is not recoverable from anyone else, because the destruction occurred while it was in their possession, and no one deceived them. This liability also covers the rent for the period it remained in their possession and any compensation for defects that occurred. The basis for this is that the recipient accepted the gift assuming the item would be soundly delivered to them.
