Who owns the profit generated from trading with usurped money or goods sold from a usurped good?
General Chapter
Al-Mughni
Book of Usurpation
Primary text
The profit belongs to the owner of the usurped property, and the purchased goods resulting from that trade also belong to the owner. This is the position of the companions of our school (Ashaabuna). If the purchase was made using the exact usurped funds, both Shurayf Abu Ja'far and Abu al-Khattab agree the profit belongs to the owner. Furthermore, it is narrated from Ahmad that the profit should be given away as charity (sadaqah).
Supporting text
If the usurper purchased the goods on his personal liability and only later paid using the usurped funds, Abu al-Khattab suggests the profit may belong to the usurper. This aligns with one opinion of Al-Shafi'i and is the view of Abu Hanifa, as the purchase was initially for himself on his liability. However, another view suggests the profit belongs to the owner from whom the property was usurped because it is an increase of his property, which is the apparent position of the Madhhab.
