Can the purchaser seek recourse against the usurper for amounts paid regarding the slave girl?
General Chapter
Al-Mughni
Book of Usurpation
Primary text
The purchaser may seek recourse against the usurper for the ransom paid for the children, as the usurper deceived him regarding the children being delivered to him without compensation and the right to intercourse without charge. If the slave girl is returned, the purchaser cannot reclaim the slave girl's value as she belongs to the original owner, but he can claim back the purchase price paid to the usurper. He is also entitled to compensation for the period of her stay with him if she commanded rent, compensation for the loss of virginity if she was a virgin, and compensation for any subsequent defects. If she died in his possession, he claims her value from the usurper.
