What is the ruling if a person usurps a garment from one owner and dye from another, and dyes the garment?
General Chapter
Al-Mughni
Book of Usurpation
Primary text
If the values of the garment and dye remain unchanged, the owners of the garment and dye become partners in the dyed garment according to the proportion of their respective property values. If the value increases, the surplus belongs to both owners proportionally. If the value decreases due to the dyeing process, the liability for the loss falls upon the usurper, and the dye owner suffers the loss, which he can reclaim from the usurper because the dye was dissipated into the garment. If the decrease is due to a drop in the market price of the garment, the dye, or both, the usurper is not liable, and the loss for each party is borne by that party's owner.
Supporting text
If the owner of the dye or the owner of the garment desires the dye to be removed, the ruling is the same as the previous case where the usurper dyed the item with his own dye.
