Is the usurper liable for compensation (Ajr) for using usurped equipment for hunting?
General Chapter
Al-Mughni
Book of Usurpation
Primary text
If it is ruled that the game belongs to the usurper, he must pay compensation (Ajr) for the use of the equipment for the duration it was in his possession, provided such equipment normally commands compensation. If the game is ruled to belong to the owner, the usurper does not receive compensation for the period of hunting in one opinion, because the benefit returned to the owner, precluding the usurper from receiving recompense from another, similar to when an owner takes crops grown on their land using their own expenses. The second opinion states that he must pay compensation equivalent to the fair market rate because he utilized the benefits of the property, similar to cases where nothing was hunted.
