What actions should be taken by heirs if the widow commits a clear gross immorality?
General Chapter
Al-Mughni
Book of Waiting Periods ('Iddah)
Primary text
If the widow commits a clear gross immorality, the heirs expel her from that specific dwelling to another dwelling within the same house, provided the house is large enough to accommodate them separately. If the house is not large enough for separation, or if moving her elsewhere in the house does not resolve the issue of their distress due to her actions, they may move her entirely.
Supporting text
Some of our companions suggest that the heirs should move out instead, as her lodging is obligatory in that specific place, but it is not obligatory for the heirs to reside there. The explicit text indicates that she should be moved, so any contrary opinion is disregarded. If the in-laws are the ones causing her harm and immorality, then the in-laws are moved, as she has not committed an immorality and thus cannot be expelled based on the text; furthermore, since the offense belongs to them, they should be the ones expelled.
