Does the delivery of a child terminate the Iddah for a woman whose marriage was consummated but the child is born less than six months from the marriage contract?
General Chapter
Al-Mughni
Book of Waiting Periods ('Iddah)
Primary text
If a child is born less than six months after the marriage contract following consummation, the Iddah is not terminated by the delivery according to the primary view. This is because the pregnancy is certainly negated from the husband, and thus delivering does not terminate the Iddah, similar to a case where the delivery occurs after his death. The evidence cited by the opposing view, Quran 65:4 (Surat Al-Talaq), is considered applicable only to divorced women and is superseded by the established legal analogy.
