What is the inheritance rule if a woman's first husband dies, or if she dies before consummating her marriage with the second husband?
General Chapter
Al-Mughni
Book of Waiting Periods ('Iddah)
Primary text
If the first husband dies, or if the wife dies before the second husband enters upon her (consummation), the surviving spouse inherits from the deceased, and the deceased inherits from the survivor. This applies because it has been established that if the first husband returns before consummation with the second husband, she returns to the first without being given an option.
Supporting text
There is an alternative report stating that she is given an option in this circumstance. Under this view, the ruling is the same as if the second husband had consummated the marriage.
