What is the legal status of a marriage contracted after the completion of the *iddah* if pregnancy doubt arises afterward?
General Chapter
Al-Mughni
Book of Waiting Periods ('Iddah)
Primary text
If the doubt concerning pregnancy arises after the completion of her waiting period and after she has remarried, the marriage is deemed valid because it occurred after the apparent completion of the *iddah*. Pregnancy, being merely a matter of doubt at that juncture, does not invalidate an act (the marriage) already established as valid. However, the new husband is prohibited from consummating the marriage because the validity of the marriage is rendered suspect. Furthermore, it is unlawful for one who believes in Allah and the Last Day to impregnate another man's field. If the wife delivers a child less than six lunar months after the second marriage and consummation, the second marriage is void because she married while pregnant. If she delivers after a period exceeding six months, the child is legally ascribed to the second husband, and his marriage is valid.
