Primary text
If the ruling permits her to marry, the second marriage is valid, and its maintenance obligations are treated like those of any other valid marriage. If the ruling forbids her from marrying, she has no maintenance from the second husband. If he spends on her, he does not recover the expense unless a judge compels payment; in that case, recovery is debatable: either he recovers because the judge ordered payment of a non-obligation, or he does not recover because a judge's ruling cannot be overturned unless it contradicts the Book, the Sunnah, or consensus.
