The waiting period ('Iddah) for a woman subjected to intercourse due to a misconception, or a woman subjected to intercourse under a void marriage (Nikah Fasid), is the same as the waiting period for a divorced woman. This is the position of Al-Shafi'i. The reasoning is that intercourse due to misconception or in a void marriage involves the occupation of the womb and the affiliation of lineage, similar to intercourse in a valid marriage. Therefore, it warrants the same consequence regarding establishing purification (Bar'ah).
