Is a conditionally manumitted slave (Mukatab) permitted to marry while still under contract?
General Chapter
Al-Mughni
Book of Walā' (Patronage)
Primary text
The conditionally manumitted slave (Mukatab) is permitted to marry while fulfilling the terms of his manumission contract. If he has children and is subsequently freed, his legal status regarding the granting of *Wala*' (patronage rights) is judged based on his status as a slave while under contract. This ruling also applies to a slave designated as *Mudabbir* (one whose freedom is deferred until the master's death) or whose manumission is suspended upon a specific condition, because they retain the legal status of a slave until the final dirham of their redemption price is paid.
