Do fixed-share heirs (Dhawi Furood) inherit the loyalty of a freed slave through the relationship of the emancipator?
Chapter on Inheritance of Wala'
Al-Mughni
Book of Walā' (Patronage)
Primary text
An heir designated for a fixed share only (Dhawi Fard Munfarid), such as the uterine brother or the spouse, does not inherit the loyalty of the emancipator's freed slave. This is because loyalty belongs exclusively to the male agnates (Asaba), and these individuals are not Asaba. They are treated in this matter as women are treated.
Supporting text
It is reported from Ahmad that women do not inherit from the loyalty except what they themselves freed, or what someone they freed had freed. An exception exists for the woman who engaged in mutual imprecation (Mula'anah), who inherits from the freed slave of her son based on the narration that considers her to be the Asaba of her son, thus having priority over his other Asaba.
