How is inheritance distributed when full brothers (from both parents) and consanguine brothers (from the father only) are present together with the grandfather?
Chapter on Inheritance of Wala'
Al-Mughni
Book of Walā' (Patronage)
Primary text
When full brothers and consanguine brothers are present, the full brothers inherit the grandfather's share by virtue of their relation through both parents. Subsequently, what accrues to them is taken by the offspring of the full brothers. The reasoning is that this situation is an inheritance between the grandfather and the brothers, resembling inheritance based on lineage.
Supporting text
Ibn Shurayh suggests that the inheritance might be divided among them based on their total number, and the offspring of the full brothers should not inherit the grandfather's share due to the father's brothers.
