Book of Walā' (Patronage)

Open in Qurani

Primary text

If two daughters are in the described situation and one purchases and frees their father, she gains the *Wala'* of that father. However, she gains no *Wala'* over her sister. Upon the father's death, the two sisters inherit two-thirds by lineage (*nasab*), and the sister who freed him takes the remaining third by virtue of the *Wala'* she acquired.

Supporting text

If the sister who benefitted from the *Wala'* dies, her sister inherits half of her estate by lineage (*nasab*), and the remaining portion goes to her paternal residuaries (*'asaba*). If she has no *'asaba*, the remaining portion is returned to the surviving sister via the return (*radd*). The surviving sister does not inherit any portion of the deceased sister's estate through *Wala'* because the deceased sister had no *Wala'* upon her.
