Who inherits the property of a deceased person who leaves behind the daughter of their freed slave (*bint mawlah*) and the freed master of their father (*mawla abihi*)?
Chapter on Inheritance of Wala'
Al-Mughni
Book of Walā' (Patronage)
Primary text
When a deceased leaves behind the daughter of their freed slave and the freed master of their father, the estate goes to the public treasury (*bayt al-mal*). This is because if the *wala'a* (allegiance/inheritance right from manumission) is established through the deceased's direct manumission act, it is not established through the manumission act of the deceased's father. If the deceased's freed master (*mawla*) has only a daughter, she does not inherit because she is not a residuary heir (*'asaba*). Only the residuary heirs of the freed master inherit. If the freed master has no residuary heirs, the inheritance does not revert to the person who freed the deceased's father.
