Who is liable for the 'Aql (blood money) when a freed slave commits a crime if the emancipator (Mawla) is alive?
Chapter on Inheritance of Wala'
Al-Mughni
Book of Walā' (Patronage)
Primary text
If the emancipator is alive, rational, and solvent, the responsibility for the 'Aql (blood money) falls upon him, and he inherits from the freed slave. This is because the emancipator is considered the 'Asaba (agnate heir) of the freed slave. If the emancipator is a child, a woman, or insane, the 'Aql falls upon his own 'Asaba.
